This page contains the terms and policies that govern your use of elftheexperience.com (the “Site”) and your visit to The Elf Experience. Together they form our “Terms and Conditions.” By using the Site, buying a ticket, or entering the venue, you confirm that you have read and accept them.
The Site is operated by HERO Entertainment LLC, a New York limited liability company doing business as HERO NYC (“HERO NYC,” “we,” “us,” or “our”), at 15 West 49th Street, Rink Level, Rockefeller Center, New York, NY [ZIP].

1. Terms of Use
These Terms of Use cover your general use of the Site and the services we provide. They are supplemented by the Privacy Policy, Cookie Policy, and Release and Waiver of Liability on this page, together with the ticketing partner’s own purchase and refund policies presented to you at checkout. Continuing to use the Site means you accept all of them.
1.1 Our role
HERO Entertainment LLC produces and operates The Elf Experience at HERO at Rockefeller Center. We are responsible for the experience itself — the venue, the activities within it, and the rules that apply on the premises.
We are not the ticketing platform. Tickets are sold, processed, and fulfilled by our authorized ticketing partners, which currently include Ticketmaster and Universe (a Ticketmaster company), and may include other partners we identify at the point of sale. Those partners collect your payment and order information under their own terms and privacy policies. We do not collect or store your full payment card details.
The Elf Experience is presented under license. “Elf” and related characters, marks, and artwork are the property of their respective owners. Those owners do not operate the Site or the experience and are not responsible for the practices described on this page unless separately stated.
1.2 Tickets, admission, and entry
- Timed entry. Tickets are for a specific date and arrival window. Please arrive no more than 15 minutes before your slot. Late arrivals may be admitted at our discretion or may forfeit entry.
- Duration. A typical visit runs approximately 40 minutes. Times are estimates, not guarantees.
- All ages. Guests of all ages are welcome. Guests under 18 must be accompanied by a ticketed adult, who accepts these Terms and the Waiver on their behalf.
- Refunds, exchanges, and transfers are governed by the ticketing partner’s purchase policy shown to you at checkout. Direct refund and exchange requests to that partner in the first instance.
- Changes and cancellation. We may change, postpone, or cancel the experience, or modify any element of it, including hours, capacity, route, scenes, characters, and staffing. Where an event is cancelled outright, refunds are handled under the ticketing partner’s policy.
- Resale. Tickets are for personal use. Resale above face value, bulk purchasing, automated purchasing, and resale through unauthorized channels are prohibited, and tickets obtained this way may be voided without refund.
- Right to refuse. We may refuse entry to, or remove, any guest who breaches these Terms, the venue rules, or applicable health and safety guidelines, without refund.
- Counterfeit tickets and altered, duplicated, or screenshot-forwarded barcodes will not be honored.
- Chargebacks. Do not initiate a chargeback for a valid purchase. If you do, the associated tickets may be voided and we may decline future purchases on that payment method.
1.3 Registration and communications
Some features of the Site and the ticketing flow require you to provide contact details or create an account with a ticketing partner. You are responsible for the accuracy of the information you provide and for all activity that takes place under your account. Do not use another person’s account without their permission, and contact us immediately at admin@hero-nyc.com if you see unauthorized activity.
We communicate with you primarily by email, and you agree that email satisfies any legal requirement that our communications be in writing. Operational emails about your booking — confirmations, pre-visit information, and changes — are part of your purchase and are sent regardless of your marketing preferences.
1.4 Conduct on the Site
Using the Site requires reasonable, good-faith conduct. You agree not to:
- Use bots, scrapers, spiders, or any automated tool to access, index, monitor, or purchase from the Site, or to place an unreasonable load on our systems.
- Conceal your IP address, impersonate another person, or use an obscene or misleading identity.
- Attempt to circumvent our security measures, including any CAPTCHA or queue system, or access accounts, systems, or data you are not authorized to access.
- Introduce malware, spam, or flooding, or otherwise interfere with other users’ access to the Site.
- Copy, download, export, reverse engineer, frame, mirror, or create derivative works from any part of the Site or its content without our written permission.
- Upload or transmit material that infringes anyone’s intellectual property, privacy, or publicity rights.
- Use a presale password, access code, or promotional code that was not issued to you.
- Reproduce, counterfeit, or tamper with tickets.
1.5 Security
We use reasonable technical and organizational measures to protect the Site and the information we hold. No internet transmission or storage system is completely secure, however, and we cannot guarantee absolute security. Keep your passwords and booking references private; we are not responsible for loss arising from someone else obtaining and misusing them.
1.6 Suspension and termination
We may modify, suspend, or discontinue any part of the Site at any time, with or without notice, without liability to you or any third party. We may also suspend or terminate your access if we believe you have breached these Terms and Conditions or the venue rules. You may stop using the Site at any time; to close an account held with a ticketing partner, contact that partner directly.
1.7 Sweepstakes, contests, and promotions
Any sweepstakes, contest, or giveaway we or our partners run will be governed by its own official rules, posted with the promotion. Read those rules before entering — they control if they conflict with this page.
1.8 Third-party links and content
The Site links to and embeds content from third parties, including ticketing partners, Instagram, Facebook, TikTok, and YouTube. We do not control those services and are not responsible for their content, availability, or practices. A link is not an endorsement.
1.9 Pricing and advertising
Prices shown on the Site or in our marketing may not be the prevailing price on the day you see the material. The price that applies is the one displayed at checkout, plus any fees and taxes disclosed there. We may correct pricing errors, including after an order is placed, and will offer you the option to cancel for a full refund where we do.
1.10 Intellectual property
All content on the Site is owned by HERO Entertainment LLC or licensed from our partners and rights holders, and is protected by copyright, trademark, and other laws. Registered and unregistered trademarks, logos, trade dress, characters, and service marks may not be used without prior written permission from their owner.
If you believe content on the Site infringes your intellectual property rights, email admin@hero-nyc.com with the subject line “Intellectual Property Violation Notice,” including identification of the work, the location of the material, your contact details, and a statement of good-faith belief. We will review the matter promptly. Our designated DMCA agent is HERO Entertainment, LLC 15 West 49th Street, Rink Level, Rockefeller Center, New York, NY .
1.11 Guests under 13
The Site is not intended for use by anyone under 13. Ticket purchases must be made by an adult. If you are the parent or legal guardian of a child under 13 who may have given us personal information, contact admin@hero-nyc.com with a COPPA Information Request and we will delete it.
1.12 Changes to these Terms
We may update these Terms and Conditions from time to time. The “Last updated” date at the top of this page shows the current version, and material changes will be signposted on the Site. Check this page to confirm you are reading the current version before relying on it.
1.13 Disclaimers and limitation of liability
If you buy a ticket, you assume the risks associated with attending the experience — including weather, crowding, and the physical activities described in the Release and Waiver of Liability below — and you agree to the terms of that Waiver. Nothing in these Terms excludes or limits any liability that cannot lawfully be excluded or limited, including liability for death or personal injury caused by our negligence, fraud, or fraudulent misrepresentation.
The Site is provided on an “AS IS” and “AS AVAILABLE” basis, and your use of it is at your own risk. You agree to indemnify, defend, and hold harmless HERO Entertainment LLC and its affiliates, service partners, successors, suppliers, attorneys, and advertisers from any liability, loss, claim, and expense — including reasonable attorneys’ fees — arising from (a) your breach of these Terms and Conditions, or (b) your reliance on the accuracy, completeness, legality, or reliability of information accessible through the Site.
THE INFORMATION, SOFTWARE, PRODUCTS, AND SERVICES INCLUDED IN OR AVAILABLE THROUGH THE SITE MAY INCLUDE INACCURACIES OR TYPOGRAPHICAL ERRORS. CHANGES ARE PERIODICALLY MADE TO THE INFORMATION ON THIS SITE. HERO ENTERTAINMENT LLC AND/OR ITS AFFILIATES MAY MAKE IMPROVEMENTS AND/OR CHANGES TO THE SITE AT ANY TIME.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE AGGREGATE LIABILITY OF HERO ENTERTAINMENT LLC AND ITS AFFILIATES IN CONNECTION WITH ANY CLAIM ARISING OUT OF OR RELATING TO THE SITE OR THESE TERMS SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID FOR THE TICKETS GIVING RISE TO THE CLAIM, OR (B) $100, AND THAT AMOUNT SHALL BE IN LIEU OF ALL OTHER REMEDIES YOU MAY HAVE AGAINST US.
ANY CAUSE OF ACTION YOU MAY HAVE WITH RESPECT TO THE SITE OR THESE TERMS MUST BE BROUGHT WITHIN ONE (1) YEAR AFTER THE CAUSE OF ACTION ARISES OR BE FOREVER WAIVED AND BARRED, EXCEPT WHERE A LONGER PERIOD IS REQUIRED BY APPLICABLE LAW.
1.14 Arbitration and disputes
Please read this section carefully. It affects your legal rights, including your right to file a lawsuit in court and to participate in a class action.
Except as set out below, any dispute or claim relating to the Site, your ticket purchase, or your visit will be finally resolved by binding individual arbitration rather than in court.
- Arbitration will be before a single arbitrator, conducted in English, and administered by the American Arbitration Association under its Consumer Arbitration Rules then in effect, under the Federal Arbitration Act.
- The arbitration will take place in the county and state of your billing address, or remotely by video or telephone at your election.
- Class action waiver. Claims will be arbitrated on an individual basis only. The arbitrator may not consolidate claims or preside over any class, collective, consolidated, or representative proceeding. You and HERO NYC each waive any right to a jury trial and to participate in a class action.
- The arbitrator’s award is binding and may be entered as a judgment in any court of competent jurisdiction.
- If the class action waiver above is found unenforceable as to any claim, this entire arbitration section will be null and void as to that claim, and it will proceed in court.
Exceptions. Either party may bring an individual claim in small claims court if it qualifies. We may seek injunctive or equitable relief in court to protect our intellectual property or the security of the Site, and you consent to the jurisdiction and venue of the state and federal courts located in New York County, New York for that purpose.
Opt-out. You may opt out of this arbitration agreement by emailing admin@hero-nyc.com with the subject “Arbitration Opt-Out,” your name, and the email address used for your purchase, within 30 days of first accepting these Terms. Opting out will not affect any other part of these Terms.
To begin arbitration, send a written notice describing your claim and the relief sought to admin@hero-nyc.com. We encourage you to contact us first — most issues are resolved informally.
1.15 Governing law
These Terms and Conditions are governed by the laws of the State of New York, without regard to its conflict of laws principles. Subject to the arbitration section above, any action must be brought exclusively in the state or federal courts located in New York County, New York. Nothing in this section deprives a consumer of the protection of mandatory consumer law in their country of residence.
1.16 Entire agreement and severability
These Terms and Conditions contain the entire understanding between you and HERO NYC relating to their subject matter, supersede all prior understandings, and cannot be changed or terminated orally. If any provision is found illegal or unenforceable, it will be limited to the minimum extent necessary to make it enforceable, and the remaining provisions will remain in full force and effect. Our failure to enforce any provision is not a waiver of it.

2. Privacy Policy
This Privacy Policy explains how HERO Entertainment LLC collects, uses, discloses, and protects personal information when you visit the Site, sign up for our emails, buy or manage tickets, or attend The Elf Experience. For privacy purposes, we are the “controller” of the personal information described below, except where we state otherwise. Read it together with the Cookie Policy in Part 3.
2.1 Information we collect
Information you give us
- Contact details — name, email address, and, if you provide them, postal code, phone number, or country.
- Marketing preferences — whether you have subscribed to our emails and your selections.
- Enquiries — the content of messages you send us about group bookings, accessibility, lost property, or order issues.
- Accessibility and accommodation requests — only what you volunteer, used only to arrange your visit.
- Survey and feedback responses, if you complete a post-visit survey or review.
Information collected automatically
- Device and connection data — IP address, device type, operating system, browser type and language, screen size.
- Usage data — pages and sections viewed, links and buttons clicked, date selections, time on page, scroll depth, referring URL, exit pages.
- Identifiers from cookies and pixels — cookie IDs, advertising identifiers, and click identifiers such as
gclid,fbclid, andttclid. - Approximate location — city- or region-level, inferred from IP address. We do not collect precise GPS location from the Site.
Information we receive from others
- Ticketing partners — booking reference, visit date and time, ticket types, and the email address used, so we can service your booking and send trip-related emails.
- Advertising and analytics platforms — aggregated campaign performance, audience insights, and conversion measurement.
- Email platform — delivery, open, click, bounce, and unsubscribe data.
- Social platforms — aggregate engagement data, and limited profile information where you consent on that platform.
2.2 How we use your information
- To operate, maintain, and secure the Site.
- To deliver and support your visit — confirmations, pre-visit information, schedule or venue changes, and post-visit follow-ups.
- To respond to your questions and requests.
- To send marketing emails where you have subscribed or where otherwise permitted by law.
- To measure and improve the Site, our content, and the guest experience.
- To plan, deliver, and measure advertising — including building audiences and measuring conversions on Google, Meta, TikTok, and other platforms.
- To prevent fraud, abuse, and ticket scalping, and to protect the rights and safety of guests and staff.
- To comply with legal obligations and enforce these Terms and Conditions.
We do not use your personal information to make decisions producing legal or similarly significant effects about you through solely automated means.

2.4 Ticket purchases
Tickets are sold and fulfilled by our ticketing partners, currently including Ticketmaster and Universe (a Ticketmaster company). Ticket pages may be hosted on a partner’s own site or embedded in ours.
- We do not collect or store your full payment card details. Payment is processed by the ticketing partner and its payment processors.
- The ticketing partner collects your information under its own privacy policy, as its own independent controller.
- We receive limited order information so we can service your booking and send trip-related emails.

2.5 Analytics and advertising
We use analytics and advertising technologies on the Site, deployed through Google Tag Manager:
- Google Analytics 4 — to understand how visitors find and use the Site.
- Google Ads — to measure conversions and show ads across Google Search, YouTube, and the Google Display Network, including remarketing.
- Meta Pixel (Facebook and Instagram) — to measure ad performance and build custom and lookalike audiences.
- TikTok Pixel — to measure ad performance and build audiences on TikTok.
- Mailchimp — to link email signups and engagement to our campaigns.
Where we use server-side or “conversions API” integrations, we may send a hashed (irreversibly scrambled) version of an email address or other identifier so the platform can match a conversion to an ad. We do not send plain-text email addresses for this purpose.
These platforms may combine what they receive from the Site with information they already hold about you, and may act as independent controllers for their own purposes. Details of each technology and how to opt out are in the Cookie Policy.
2.6 Email marketing
Our emails are sent using Mailchimp (Intuit Inc.), including transactional messages delivered through Mailchimp Transactional (Mandrill).
- Marketing emails — sent only if you subscribe. Every marketing email includes an unsubscribe link.
- Transactional emails — order confirmations, pre-visit instructions, and operational updates. These are part of your booking and are sent regardless of marketing preferences.
- Email measurement — our emails may contain tracking pixels and tagged links that tell us whether a message was opened and which links were clicked. Disable remote image loading in your email client to limit this.

2.7 When we share information
We do not sell your personal information for money. We share it:
- With service providers — hosting and site platform (Framer), email (Mailchimp/Intuit), analytics, customer support, survey tools, and IT security vendors, each acting on our instructions.
- With ticketing partners — Ticketmaster, Universe, and any other partner named at the point of sale.
- With venue and event partners — including HERO at Rockefeller Center operational partners, as needed to run the experience.
- With advertising and analytics platforms — Google, Meta, and TikTok, as described above.
- With licensors and rights holders — aggregate performance reporting required under our license agreements.
- For legal and safety reasons — where required by law or legal process, or to protect the rights, property, or safety of guests, staff, or the public.
- In corporate transactions — a merger, financing, reorganization, or sale of assets, subject to appropriate protections.
2.8 “Sale” and “sharing” of personal information
Under some US state privacy laws, using advertising cookies and pixels — such as those from Google, Meta, and TikTok — counts as a “sale” of personal information or as “sharing” it for cross-context behavioral advertising, even though no money changes hands. In the past 12 months we have shared these categories for those purposes:
- Identifiers, including cookie and advertising IDs, IP address, and hashed email addresses
- Internet and network activity, including browsing and interaction data on the Site
- Commercial information, including ticket purchase and interest signals
- Inferences drawn from the above, such as audience or interest segments
We do not knowingly sell or share the personal information of anyone under 16. We do not process sensitive personal information to infer characteristics about you.
To opt out, use the “Do Not Sell or Share My Personal Information” link in our footer, reject advertising cookies in the cookie banner, or send a Global Privacy Control (GPC) signal from your browser, which we honor as a valid opt-out for that browser and device.
2.9 How long we keep information

2.10 International transfers
We are based in the United States, and our service providers may process personal information in the United States and other countries whose data protection laws differ from those where you live. Where we transfer personal information out of the EEA, the UK, or Switzerland, we rely on appropriate safeguards — typically the European Commission’s Standard Contractual Clauses with the UK Addendum or International Data Transfer Agreement, plus supplementary measures where needed. 2.11 Security
We use administrative, technical, and physical safeguards designed to protect personal information, including encryption in transit, access controls, and vendor due diligence. No system is perfectly secure, and we cannot guarantee the security of information transmitted over the internet.
2.12 Your US privacy rights
Depending on your state of residence — including California, Colorado, Connecticut, Virginia, Utah, Texas, Oregon, Montana, and other states with comprehensive privacy laws — you may have the right to:
- Know or access the personal information we have collected, including categories, sources, purposes, and the parties we disclose it to
- Delete personal information we hold about you, subject to legal exceptions
- Correct inaccurate personal information
- Obtain a portable copy of personal information you provided to us
- Opt out of the sale or sharing of personal information and of targeted advertising
- Limit the use of sensitive personal information (we do not use it for purposes that trigger this right)
- Not be discriminated against for exercising these rights
- Appeal a decision we make about your request, where your state provides an appeal right
Authorized agents. You may use an authorized agent to submit a request. We may ask the agent for proof of authorization and ask you to verify your identity directly.
Nevada residents may submit a request not to have covered personal information sold to admin@hero-nyc.com.
2.13 Your EEA/UK privacy rights
If you are in the EEA or the UK, you have the right to access, rectify, erase, restrict, or object to our processing, the right to data portability, and the right to withdraw consent at any time without affecting processing carried out before withdrawal.
You may lodge a complaint with your local supervisory authority, or with the UK Information Commissioner’s Office (ico.org.uk). We would appreciate the chance to address your concerns first.
2.14 How to exercise your rights
Email admin@hero-nyc.com with “Privacy Request” in the subject line, or write to us at 15 West 49th Street, Rink Level, Rockefeller Center, New York, NY [ZIP]. Tell us which right you want to exercise and the email address you used with us, so we can locate your records.
We verify your identity before acting on a request, usually by confirming you control the email address associated with your information. We respond within the time required by applicable law — generally 45 days under US state laws, or one month under the GDPR and UK GDPR — and will tell you if we need an extension.
2.15 Children
The Elf Experience welcomes guests of all ages, but this Site is intended for adults. We do not knowingly collect personal information from children under 13, and tickets must be purchased by an adult. If you believe a child has provided us with personal information, contact admin@hero-nyc.com and we will delete it. We do not knowingly sell or share the personal information of consumers under 16.
2.16 Changes to this Policy
We may update this Policy from time to time. When we do, we revise the “Last updated” date at the top of this page, and for material changes we provide additional notice — for example, a banner on the Site or an email to subscribers.

3. Cookie Policy
This Cookie Policy explains how we use cookies and similar technologies on the Site.
3.1 What cookies and similar technologies are
A cookie is a small text file placed on your device when you visit a website. Cookies set by the site you are visiting are first-party; cookies set by another company, such as an advertising platform, are third-party. A session cookie is deleted when you close your browser; a persistent cookie stays until it expires or you delete it.
We also use:
- Pixels and tags — tiny transparent images or code snippets that record a page view or action and pass it to a platform such as Google, Meta, or TikTok.
- Local storage — data saved by your browser to remember settings or state between pages.
- Tag managers — Google Tag Manager, which loads and controls the tags below. It does not set cookies of its own.
- Server-side and conversions APIs — measurement that runs on a server rather than in your browser, described in Section 2.5.

3.4 Your choices and consent
When you first visit the Site, a cookie banner asks for your choices. Strictly necessary cookies are set automatically because the Site cannot work without them. Analytics, functional, targeting, and social media cookies are set only if you accept them, and you can accept or reject each category separately.
Change or withdraw your choices at any time using Cookie Settings above or in the Site footer. Withdrawing consent does not remove cookies already set — delete those through your browser — and does not affect processing carried out before you withdrew.
If you are in the EEA or the UK, we do not set non-essential cookies until you consent. If you are in the United States, you may opt out of targeting cookies at any time through Cookie Settings, the “Do Not Sell or Share My Personal Information” link in the footer, or a Global Privacy Control signal.
3.5 Browser and device controls
You can block or delete cookies through your browser settings. Blocking all cookies will break parts of the Site, including the ticketing flow.
On mobile, you can also limit ad tracking in your system settings — “Allow Apps to Request to Track” on iOS, or “Delete advertising ID” on Android.

Opting out stops ads being personalized to you. You will still see ads, and they may be less relevant.
3.7 Global Privacy Control and Do Not Track
We recognize the Global Privacy Control (GPC) signal and treat it as a request to opt out of the sale and sharing of personal information and of targeted advertising for that browser and device. There is no common industry standard for “Do Not Track” browser signals, so we do not currently respond to them differently.
3.8 Cookies and pixels in our emails
Our emails are sent through Mailchimp and may contain tracking pixels and tagged links that tell us whether a message was opened and which links were clicked. To limit this, turn off automatic image loading in your email client, or unsubscribe using the link at the bottom of any marketing email.
4. Release and Waiver of Liability
This Release and Waiver of Liability applies to every guest. You accept it when you purchase a ticket and when you enter the venue. If you are purchasing for, or accompanying, a minor, you accept it on their behalf as their parent or legal guardian.
RELEASE AND WAIVER OF LIABILITY BY PARTICIPANT IN FAVOR OF HERO ENTERTAINMENT LLC
In consideration for being permitted to participate in the activities that HERO Entertainment LLC d/b/a HERO NYC (“HERO Entertainment LLC”) will provide and/or being provided access to and use of its premises, I, on behalf of myself and my participating minor child/children, if any, agree to the following:
- ACTIVITIES, USE OF PREMISES, AND ASSUMPTION OF RISK. I understand the activities HERO Entertainment LLC will provide and in which I and/or my minor child/children, if any, will participate may involve risks. Those risks may include slipping, falling, injury from falling objects, allergic reactions, and exposure to theatrical effects such as artificial snow, fog, strobe lighting, and loud sound, which may be inherently dangerous, and can cause serious or grievous illness or injuries, including serious bodily injury such as broken bones or concussion, catastrophic injury such as paralysis, or death. I have explained these risks to my participating minor child/children, if any. In spite of the risks mentioned above, I freely want to participate and want my child/children, if any, to participate in the activities provided by HERO Entertainment LLC. I understand that these activities may not be supervised and that, in the event of injury, medical services may not be readily available. Neither my participating minor child/children, if any, nor I are suffering from any mental, emotional, or physical condition precluding participation in any activities that HERO Entertainment LLC will provide. I, on behalf of myself and my participating minor child/children, if any, assume all of the risks of participating in any activities provided by HERO Entertainment LLC and/or on its premises.
- RELEASE AND WAIVER OF LIABILITY. I, on behalf of myself and my participating minor child/children, if any, hereby WAIVE AND RELEASE HERO Entertainment LLC and its agents, employees, officers, directors, affiliates, successors and assigns of and from any and all claims, demands, debts, contracts, expenses, causes of action, lawsuits, damages, and liabilities of every kind and nature, whether known or unknown, in law or equity, that I or my participating minor child/children, if any, ever had or may have, arising from or in any way related to my or their participation in any of the activities provided by, on the premises of, or for the benefit of HERO Entertainment LLC. This release and waiver of liability applies to all acts of ordinary negligence but does not apply to any acts of gross negligence or intentional, willful, or wanton misconduct.
- COVENANT NOT TO SUE. I, on behalf of myself and my participating minor child/children, if any, agree not to sue HERO Entertainment LLC or any of its agents, employees, officers, directors, affiliates, successors or assigns, or initiate or assist in the prosecution of any claim for damages or cause of action against any of them, which I, on behalf of myself or my participating minor child/children, if any, may have as a result of any personal injury, death, or property damage that I or my participating minor child/children, if any, may sustain by participating in any activities provided by HERO Entertainment LLC and/or on its premises.
- INDEMNIFICATION. I, on behalf of myself and my participating minor child/children, if any, agree to indemnify and hold harmless HERO Entertainment LLC and its agents, employees, officers, directors, affiliates, successors and assigns from any and all liabilities, claims, costs, and expenses (including reasonable attorneys’ fees) made by other individuals or entities as a result of my or my participating minor child’s/children’s actions in connection with any activities provided by HERO Entertainment LLC and/or on its premises.
- LOST, DAMAGED, AND STOLEN ITEMS. HERO Entertainment LLC has no responsibility for lost, damaged, or stolen items.
- PHOTOGRAPHS AND VIDEOTAPE. I, on behalf of myself and my participating minor child/children, if any, grant HERO Entertainment LLC the right to photograph, videotape, and/or record me and/or my participating minor child/children, if any, and to use my and my participating minor child’s/children’s name, face, likeness, voice, and appearance in connection with exhibitions, publicity, advertising, and promotional materials without reservation or limitation, and I, on behalf of myself and my participating minor child/children, waive any right to royalties or other compensation arising from any such use.
- SUCCESSORS AND ASSIGNS. This RELEASE AND WAIVER OF LIABILITY is binding on my and my participating minor child’s/children’s successors and assigns, including any spouses, heirs, executors, administrators, and legal representatives.
- GOVERNING LAW AND VENUE. This RELEASE AND WAIVER OF LIABILITY shall be governed by and interpreted in accordance with the laws of New York, without giving effect to the principles of conflicts of law. Any action arising out of this RELEASE AND WAIVER OF LIABILITY must be brought exclusively in a state or federal court located in New York County, New York.
- INTERPRETATION OF AGREEMENT. This RELEASE AND WAIVER OF LIABILITY shall be construed broadly to provide a release and waiver to the fullest extent permissible under applicable law. The failure of HERO Entertainment LLC to enforce any provision of this RELEASE AND WAIVER OF LIABILITY shall not be construed as a waiver or modification of such provision or impairment of its right to enforce such provision or any other provision of this RELEASE AND WAIVER OF LIABILITY.
- SEVERABILITY. If any provision or portion of this RELEASE AND WAIVER OF LIABILITY shall be held to be illegal, invalid, or unenforceable, the remaining provisions or portions shall remain in full force and effect.
- HEALTH & SAFETY PROTOCOLS. I, on behalf of myself and any participating adults and minor child/children, if any, under my care agree to adhere to any Health & Safety Guidelines in place by HERO Entertainment LLC and understand that failing to adhere to these policies/guidelines may result in removal of myself and my group from the premises. By failing to adhere to these policies/guidelines, I may not be eligible for a refund or exchange, as deemed by HERO Entertainment LLC.
- ENTIRE AGREEMENT. This RELEASE AND WAIVER OF LIABILITY contains the entire agreement between the parties and supersedes any prior written or oral agreements between them concerning the subject matter of this RELEASE AND WAIVER OF LIABILITY. The provisions of this RELEASE AND WAIVER OF LIABILITY may be waived, altered, amended, or repealed, in whole or in part, only upon the prior written consent of all parties. The provisions of this RELEASE AND WAIVER OF LIABILITY will continue in full force and effect even after the termination of the activities provided by, on the premises of, or for the benefit of HERO Entertainment LLC.
I, ON BEHALF OF MYSELF AND MY PARTICIPATING MINOR CHILD/CHILDREN, IF ANY, ACKNOWLEDGE THAT I HAVE CAREFULLY READ THIS RELEASE AND WAIVER OF LIABILITY AND THAT I UNDERSTAND THE TERMS SET FORTH HEREIN AND THAT I UNDERSTAND THAT IT IS A RELEASE OF LIABILITY AND A WAIVER OF RIGHTS THAT I MAY HAVE ON BEHALF OF MYSELF AND MY CHILD/CHILDREN TO BRING A LEGAL ACTION OR ASSERT A CLAIM FOR INJURY OR LOSS AGAINST HERO ENTERTAINMENT LLC. SHOULD ANY LEGAL ACTION BE COMMENCED OR ANY CLAIM ASSERTED IN VIOLATION OF THIS RELEASE AND WAIVER OF LIABILITY, I UNDERSTAND AND AGREE THAT I, ON BEHALF OF MYSELF AND MY PARTICIPATING MINOR CHILD/CHILDREN, IF ANY, WILL BE RESPONSIBLE FOR ALL REASONABLE ATTORNEYS’ FEES AND DEFENSE COSTS INCURRED BY HERO ENTERTAINMENT LLC D/B/A HERO NYC AND ITS AGENTS, EMPLOYEES, OFFICERS, DIRECTORS, AFFILIATES, SUCCESSORS AND ASSIGNS IN CONNECTION WITH OR IN DEFENSE OF SUCH ACTION OR CLAIM. I HAVE SIGNED THIS AGREEMENT FREELY, VOLUNTARILY, AND UNDER NO DURESS OR THREAT OF DURESS.
I have read and agree to the above waiver and accept it on behalf of myself and all participating adults and child(ren) under my care.

This page contains the terms and policies that govern your use of elftheexperience.com (the “Site”) and your visit to The Elf Experience. Together they form our “Terms and Conditions.” By using the Site, buying a ticket, or entering the venue, you confirm that you have read and accept them.
The Site is operated by HERO Entertainment LLC, a New York limited liability company doing business as HERO NYC (“HERO NYC,” “we,” “us,” or “our”), at 15 West 49th Street, Rink Level, Rockefeller Center, New York, NY [ZIP].

1. Terms of Use
These Terms of Use cover your general use of the Site and the services we provide. They are supplemented by the Privacy Policy, Cookie Policy, and Release and Waiver of Liability on this page, together with the ticketing partner’s own purchase and refund policies presented to you at checkout. Continuing to use the Site means you accept all of them.
1.1 Our role
HERO Entertainment LLC produces and operates The Elf Experience at HERO at Rockefeller Center. We are responsible for the experience itself — the venue, the activities within it, and the rules that apply on the premises.
We are not the ticketing platform. Tickets are sold, processed, and fulfilled by our authorized ticketing partners, which currently include Ticketmaster and Universe (a Ticketmaster company), and may include other partners we identify at the point of sale. Those partners collect your payment and order information under their own terms and privacy policies. We do not collect or store your full payment card details.
The Elf Experience is presented under license. “Elf” and related characters, marks, and artwork are the property of their respective owners. Those owners do not operate the Site or the experience and are not responsible for the practices described on this page unless separately stated.
1.2 Tickets, admission, and entry
- Timed entry. Tickets are for a specific date and arrival window. Please arrive no more than 15 minutes before your slot. Late arrivals may be admitted at our discretion or may forfeit entry.
- Duration. A typical visit runs approximately 40 minutes. Times are estimates, not guarantees.
- All ages. Guests of all ages are welcome. Guests under 18 must be accompanied by a ticketed adult, who accepts these Terms and the Waiver on their behalf.
- Refunds, exchanges, and transfers are governed by the ticketing partner’s purchase policy shown to you at checkout. Direct refund and exchange requests to that partner in the first instance.
- Changes and cancellation. We may change, postpone, or cancel the experience, or modify any element of it, including hours, capacity, route, scenes, characters, and staffing. Where an event is cancelled outright, refunds are handled under the ticketing partner’s policy.
- Resale. Tickets are for personal use. Resale above face value, bulk purchasing, automated purchasing, and resale through unauthorized channels are prohibited, and tickets obtained this way may be voided without refund.
- Right to refuse. We may refuse entry to, or remove, any guest who breaches these Terms, the venue rules, or applicable health and safety guidelines, without refund.
- Counterfeit tickets and altered, duplicated, or screenshot-forwarded barcodes will not be honored.
- Chargebacks. Do not initiate a chargeback for a valid purchase. If you do, the associated tickets may be voided and we may decline future purchases on that payment method.
1.3 Registration and communications
Some features of the Site and the ticketing flow require you to provide contact details or create an account with a ticketing partner. You are responsible for the accuracy of the information you provide and for all activity that takes place under your account. Do not use another person’s account without their permission, and contact us immediately at admin@hero-nyc.com if you see unauthorized activity.
We communicate with you primarily by email, and you agree that email satisfies any legal requirement that our communications be in writing. Operational emails about your booking — confirmations, pre-visit information, and changes — are part of your purchase and are sent regardless of your marketing preferences.
1.4 Conduct on the Site
Using the Site requires reasonable, good-faith conduct. You agree not to:
- Use bots, scrapers, spiders, or any automated tool to access, index, monitor, or purchase from the Site, or to place an unreasonable load on our systems.
- Conceal your IP address, impersonate another person, or use an obscene or misleading identity.
- Attempt to circumvent our security measures, including any CAPTCHA or queue system, or access accounts, systems, or data you are not authorized to access.
- Introduce malware, spam, or flooding, or otherwise interfere with other users’ access to the Site.
- Copy, download, export, reverse engineer, frame, mirror, or create derivative works from any part of the Site or its content without our written permission.
- Upload or transmit material that infringes anyone’s intellectual property, privacy, or publicity rights.
- Use a presale password, access code, or promotional code that was not issued to you.
- Reproduce, counterfeit, or tamper with tickets.
1.5 Security
We use reasonable technical and organizational measures to protect the Site and the information we hold. No internet transmission or storage system is completely secure, however, and we cannot guarantee absolute security. Keep your passwords and booking references private; we are not responsible for loss arising from someone else obtaining and misusing them.
1.6 Suspension and termination
We may modify, suspend, or discontinue any part of the Site at any time, with or without notice, without liability to you or any third party. We may also suspend or terminate your access if we believe you have breached these Terms and Conditions or the venue rules. You may stop using the Site at any time; to close an account held with a ticketing partner, contact that partner directly.
1.7 Sweepstakes, contests, and promotions
Any sweepstakes, contest, or giveaway we or our partners run will be governed by its own official rules, posted with the promotion. Read those rules before entering — they control if they conflict with this page.
1.8 Third-party links and content
The Site links to and embeds content from third parties, including ticketing partners, Instagram, Facebook, TikTok, and YouTube. We do not control those services and are not responsible for their content, availability, or practices. A link is not an endorsement.
1.9 Pricing and advertising
Prices shown on the Site or in our marketing may not be the prevailing price on the day you see the material. The price that applies is the one displayed at checkout, plus any fees and taxes disclosed there. We may correct pricing errors, including after an order is placed, and will offer you the option to cancel for a full refund where we do.
1.10 Intellectual property
All content on the Site is owned by HERO Entertainment LLC or licensed from our partners and rights holders, and is protected by copyright, trademark, and other laws. Registered and unregistered trademarks, logos, trade dress, characters, and service marks may not be used without prior written permission from their owner.
If you believe content on the Site infringes your intellectual property rights, email admin@hero-nyc.com with the subject line “Intellectual Property Violation Notice,” including identification of the work, the location of the material, your contact details, and a statement of good-faith belief. 1.11 Guests under 13
The Site is not intended for use by anyone under 13. Ticket purchases must be made by an adult. If you are the parent or legal guardian of a child under 13 who may have given us personal information, contact admin@hero-nyc.com with a COPPA Information Request and we will delete it.
1.12 Changes to these Terms
We may update these Terms and Conditions from time to time. The “Last updated” date at the top of this page shows the current version, and material changes will be signposted on the Site. Check this page to confirm you are reading the current version before relying on it.
1.13 Disclaimers and limitation of liability
If you buy a ticket, you assume the risks associated with attending the experience — including weather, crowding, and the physical activities described in the Release and Waiver of Liability below — and you agree to the terms of that Waiver. Nothing in these Terms excludes or limits any liability that cannot lawfully be excluded or limited, including liability for death or personal injury caused by our negligence, fraud, or fraudulent misrepresentation.
The Site is provided on an “AS IS” and “AS AVAILABLE” basis, and your use of it is at your own risk. You agree to indemnify, defend, and hold harmless HERO Entertainment LLC and its affiliates, service partners, successors, suppliers, attorneys, and advertisers from any liability, loss, claim, and expense — including reasonable attorneys’ fees — arising from (a) your breach of these Terms and Conditions, or (b) your reliance on the accuracy, completeness, legality, or reliability of information accessible through the Site.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE AGGREGATE LIABILITY OF HERO ENTERTAINMENT LLC AND ITS AFFILIATES IN CONNECTION WITH ANY CLAIM ARISING OUT OF OR RELATING TO THE SITE OR THESE TERMS SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID FOR THE TICKETS GIVING RISE TO THE CLAIM, OR (B) $100, AND THAT AMOUNT SHALL BE IN LIEU OF ALL OTHER REMEDIES YOU MAY HAVE AGAINST US.
ANY CAUSE OF ACTION YOU MAY HAVE WITH RESPECT TO THE SITE OR THESE TERMS MUST BE BROUGHT WITHIN ONE (1) YEAR AFTER THE CAUSE OF ACTION ARISES OR BE FOREVER WAIVED AND BARRED, EXCEPT WHERE A LONGER PERIOD IS REQUIRED BY APPLICABLE LAW.
1.14 Arbitration and disputes
Please read this section carefully. It affects your legal rights, including your right to file a lawsuit in court and to participate in a class action.
Except as set out below, any dispute or claim relating to the Site, your ticket purchase, or your visit will be finally resolved by binding individual arbitration rather than in court.
- Arbitration will be before a single arbitrator, conducted in English, and administered by the American Arbitration Association under its Consumer Arbitration Rules then in effect, under the Federal Arbitration Act.
- The arbitration will take place in the county and state of your billing address, or remotely by video or telephone at your election.
- Class action waiver. Claims will be arbitrated on an individual basis only. The arbitrator may not consolidate claims or preside over any class, collective, consolidated, or representative proceeding. You and HERO NYC each waive any right to a jury trial and to participate in a class action.
- The arbitrator’s award is binding and may be entered as a judgment in any court of competent jurisdiction.
- If the class action waiver above is found unenforceable as to any claim, this entire arbitration section will be null and void as to that claim, and it will proceed in court.
Exceptions. Either party may bring an individual claim in small claims court if it qualifies. We may seek injunctive or equitable relief in court to protect our intellectual property or the security of the Site, and you consent to the jurisdiction and venue of the state and federal courts located in New York County, New York for that purpose.
Opt-out. You may opt out of this arbitration agreement by emailing admin@hero-nyc.com with the subject “Arbitration Opt-Out,” your name, and the email address used for your purchase, within 30 days of first accepting these Terms. Opting out will not affect any other part of these Terms.
To begin arbitration, send a written notice describing your claim and the relief sought to admin@hero-nyc.com. We encourage you to contact us first — most issues are resolved informally.
1.15 Governing law
These Terms and Conditions are governed by the laws of the State of New York, without regard to its conflict of laws principles. Subject to the arbitration section above, any action must be brought exclusively in the state or federal courts located in New York County, New York. Nothing in this section deprives a consumer of the protection of mandatory consumer law in their country of residence.
1.16 Entire agreement and severability
These Terms and Conditions contain the entire understanding between you and HERO NYC relating to their subject matter, supersede all prior understandings, and cannot be changed or terminated orally. If any provision is found illegal or unenforceable, it will be limited to the minimum extent necessary to make it enforceable, and the remaining provisions will remain in full force and effect. Our failure to enforce any provision is not a waiver of it.

2. Privacy Policy
This Privacy Policy explains how HERO Entertainment LLC collects, uses, discloses, and protects personal information when you visit the Site, sign up for our emails, buy or manage tickets, or attend The Elf Experience. For privacy purposes, we are the “controller” of the personal information described below, except where we state otherwise. Read it together with the Cookie Policy in Part 3.
2.1 Information we collect

- Contact details — name, email address, and, if you provide them, postal code, phone number, or country.
- Marketing preferences — whether you have subscribed to our emails and your selections.
- Enquiries — the content of messages you send us about group bookings, accessibility, lost property, or order issues.
- Accessibility and accommodation requests — only what you volunteer, used only to arrange your visit.
- Survey and feedback responses, if you complete a post-visit survey or review.
Information collected automatically
- Device and connection data — IP address, device type, operating system, browser type and language, screen size.
- Usage data — pages and sections viewed, links and buttons clicked, date selections, time on page, scroll depth, referring URL, exit pages.
- Identifiers from cookies and pixels — cookie IDs, advertising identifiers, and click identifiers such as
gclid,fbclid, andttclid. - Approximate location — city- or region-level, inferred from IP address. We do not collect precise GPS location from the Site.
Information we receive from others
- Ticketing partners — booking reference, visit date and time, ticket types, and the email address used, so we can service your booking and send trip-related emails.
- Advertising and analytics platforms — aggregated campaign performance, audience insights, and conversion measurement.
- Email platform — delivery, open, click, bounce, and unsubscribe data.
- Social platforms — aggregate engagement data, and limited profile information where you consent on that platform.
2.2 How we use your information
- To operate, maintain, and secure the Site.
- To deliver and support your visit — confirmations, pre-visit information, schedule or venue changes, and post-visit follow-ups.
- To respond to your questions and requests.
- To send marketing emails where you have subscribed or where otherwise permitted by law.
- To measure and improve the Site, our content, and the guest experience.
- To plan, deliver, and measure advertising — including building audiences and measuring conversions on Google, Meta, TikTok, and other platforms.
- To prevent fraud, abuse, and ticket scalping, and to protect the rights and safety of guests and staff.
- To comply with legal obligations and enforce these Terms and Conditions.
We do not use your personal information to make decisions producing legal or similarly significant effects about you through solely automated means.

2.4 Ticket purchases
Tickets are sold and fulfilled by our ticketing partners, currently including Ticketmaster and Universe (a Ticketmaster company). Ticket pages may be hosted on a partner’s own site or embedded in ours.
- We do not collect or store your full payment card details. Payment is processed by the ticketing partner and its payment processors.
- The ticketing partner collects your information under its own privacy policy, as its own independent controller.
- We receive limited order information so we can service your booking and send trip-related emails.

2.5 Analytics and advertising
We use analytics and advertising technologies on the Site, deployed through Google Tag Manager:
- Google Analytics 4 — to understand how visitors find and use the Site.
- Google Ads — to measure conversions and show ads across Google Search, YouTube, and the Google Display Network, including remarketing.
- Meta Pixel (Facebook and Instagram) — to measure ad performance and build custom and lookalike audiences.
- TikTok Pixel — to measure ad performance and build audiences on TikTok.
- Mailchimp — to link email signups and engagement to our campaigns.
Where we use server-side or “conversions API” integrations, we may send a hashed (irreversibly scrambled) version of an email address or other identifier so the platform can match a conversion to an ad. We do not send plain-text email addresses for this purpose.
These platforms may combine what they receive from the Site with information they already hold about you, and may act as independent controllers for their own purposes. Details of each technology and how to opt out are in the Cookie Policy.
2.6 Email marketing
Our emails are sent using Mailchimp (Intuit Inc.), including transactional messages delivered through Mailchimp Transactional (Mandrill).
- Marketing emails — sent only if you subscribe. Every marketing email includes an unsubscribe link.
- Transactional emails — order confirmations, pre-visit instructions, and operational updates. These are part of your booking and are sent regardless of marketing preferences.
- Email measurement — our emails may contain tracking pixels and tagged links that tell us whether a message was opened and which links were clicked. Disable remote image loading in your email client to limit this.

2.7 When we share information
We do not sell your personal information for money. We share it:
- With service providers — hosting and site platform (Framer), email (Mailchimp/Intuit), analytics, customer support, survey tools, and IT security vendors, each acting on our instructions.
- With ticketing partners — Ticketmaster, Universe, and any other partner named at the point of sale.
- With venue and event partners — including HERO at Rockefeller Center operational partners, as needed to run the experience.
- With advertising and analytics platforms — Google, Meta, and TikTok, as described above.
- With licensors and rights holders — aggregate performance reporting required under our license agreements.
- For legal and safety reasons — where required by law or legal process, or to protect the rights, property, or safety of guests, staff, or the public.
- In corporate transactions — a merger, financing, reorganization, or sale of assets, subject to appropriate protections.
2.8 “Sale” and “sharing” of personal information
Under some US state privacy laws, using advertising cookies and pixels — such as those from Google, Meta, and TikTok — counts as a “sale” of personal information or as “sharing” it for cross-context behavioral advertising, even though no money changes hands. In the past 12 months we have shared these categories for those purposes:
- Identifiers, including cookie and advertising IDs, IP address, and hashed email addresses
- Internet and network activity, including browsing and interaction data on the Site
- Commercial information, including ticket purchase and interest signals
- Inferences drawn from the above, such as audience or interest segments
We do not knowingly sell or share the personal information of anyone under 16. We do not process sensitive personal information to infer characteristics about you.
To opt out, use the “Do Not Sell or Share My Personal Information” link in our footer, reject advertising cookies in the cookie banner, or send a Global Privacy Control (GPC) signal from your browser, which we honor as a valid opt-out for that browser and device.

2.10 International transfers
We are based in the United States, and our service providers may process personal information in the United States and other countries whose data protection laws differ from those where you live. Where we transfer personal information out of the EEA, the UK, or Switzerland, we rely on appropriate safeguards — typically the European Commission’s Standard Contractual Clauses with the UK Addendum or International Data Transfer Agreement, plus supplementary measures where needed. 2.11 Security
We use administrative, technical, and physical safeguards designed to protect personal information, including encryption in transit, access controls, and vendor due diligence. No system is perfectly secure, and we cannot guarantee the security of information transmitted over the internet.
2.12 Your US privacy rights
Depending on your state of residence — including California, Colorado, Connecticut, Virginia, Utah, Texas, Oregon, Montana, and other states with comprehensive privacy laws — you may have the right to:
- Know or access the personal information we have collected, including categories, sources, purposes, and the parties we disclose it to
- Delete personal information we hold about you, subject to legal exceptions
- Correct inaccurate personal information
- Obtain a portable copy of personal information you provided to us
- Opt out of the sale or sharing of personal information and of targeted advertising
- Limit the use of sensitive personal information (we do not use it for purposes that trigger this right)
- Not be discriminated against for exercising these rights
- Appeal a decision we make about your request, where your state provides an appeal right
Authorized agents. You may use an authorized agent to submit a request. We may ask the agent for proof of authorization and ask you to verify your identity directly.
Nevada residents may submit a request not to have covered personal information sold to admin@hero-nyc.com.
2.13 Your EEA/UK privacy rights
If you are in the EEA or the UK, you have the right to access, rectify, erase, restrict, or object to our processing, the right to data portability, and the right to withdraw consent at any time without affecting processing carried out before withdrawal.
You may lodge a complaint with your local supervisory authority, or with the UK Information Commissioner’s Office (ico.org.uk). We would appreciate the chance to address your concerns first.
2.14 How to exercise your rights
Email admin@hero-nyc.com with “Privacy Request” in the subject line, or write to us at 15 West 49th Street, Rink Level, Rockefeller Center, New York, NY [ZIP]. Tell us which right you want to exercise and the email address you used with us, so we can locate your records.
We verify your identity before acting on a request, usually by confirming you control the email address associated with your information. We respond within the time required by applicable law — generally 45 days under US state laws, or one month under the GDPR and UK GDPR — and will tell you if we need an extension.
2.15 Children
The Elf Experience welcomes guests of all ages, but this Site is intended for adults. We do not knowingly collect personal information from children under 13, and tickets must be purchased by an adult. If you believe a child has provided us with personal information, contact admin@hero-nyc.com and we will delete it. We do not knowingly sell or share the personal information of consumers under 16.
2.16 Changes to this Policy
We may update this Policy from time to time. When we do, we revise the “Last updated” date at the top of this page, and for material changes we provide additional notice — for example, a banner on the Site or an email to subscribers.

3.1 What cookies and similar technologies are
A cookie is a small text file placed on your device when you visit a website. Cookies set by the site you are visiting are first-party; cookies set by another company, such as an advertising platform, are third-party. A session cookie is deleted when you close your browser; a persistent cookie stays until it expires or you delete it.
We also use:
- Pixels and tags — tiny transparent images or code snippets that record a page view or action and pass it to a platform such as Google, Meta, or TikTok.

3.4 Your choices and consent
When you first visit the Site, a cookie banner asks for your choices. Strictly necessary cookies are set automatically because the Site cannot work without them. Analytics, functional, targeting, and social media cookies are set only if you accept them, and you can accept or reject each category separately.
Change or withdraw your choices at any time using Cookie Settings above or in the Site footer. Withdrawing consent does not remove cookies already set — delete those through your browser — and does not affect processing carried out before you withdrew.
If you are in the EEA or the UK, we do not set non-essential cookies until you consent. If you are in the United States, you may opt out of targeting cookies at any time through Cookie Settings, the “Do Not Sell or Share My Personal Information” link in the footer, or a Global Privacy Control signal.
3.5 Browser and device controls
You can block or delete cookies through your browser settings. Blocking all cookies will break parts of the Site, including the ticketing flow.
On mobile, you can also limit ad tracking in your system settings — “Allow Apps to Request to Track” on iOS, or “Delete advertising ID” on Android.

Opting out stops ads being personalized to you. You will still see ads, and they may be less relevant.
3.7 Global Privacy Control and Do Not Track
We recognize the Global Privacy Control (GPC) signal and treat it as a request to opt out of the sale and sharing of personal information and of targeted advertising for that browser and device. There is no common industry standard for “Do Not Track” browser signals, so we do not currently respond to them differently.
3.8 Cookies and pixels in our emails
Our emails are sent through Mailchimp and may contain tracking pixels and tagged links that tell us whether a message was opened and which links were clicked. To limit this, turn off automatic image loading in your email client, or unsubscribe using the link at the bottom of any marketing email.
4. Release and Waiver of Liability
This Release and Waiver of Liability applies to every guest. You accept it when you purchase a ticket and when you enter the venue. If you are purchasing for, or accompanying, a minor, you accept it on their behalf as their parent or legal guardian.
RELEASE AND WAIVER OF LIABILITY BY PARTICIPANT IN FAVOR OF HERO ENTERTAINMENT LLC
In consideration for being permitted to participate in the activities that HERO Entertainment LLC d/b/a HERO NYC (“HERO Entertainment LLC”) will provide and/or being provided access to and use of its premises, I, on behalf of myself and my participating minor child/children, if any, agree to the following:
- ACTIVITIES, USE OF PREMISES, AND ASSUMPTION OF RISK. I understand the activities HERO Entertainment LLC will provide and in which I and/or my minor child/children, if any, will participate may involve risks. Those risks may include slipping, falling, injury from falling objects, allergic reactions, and exposure to theatrical effects such as artificial snow, fog, strobe lighting, and loud sound, which may be inherently dangerous, and can cause serious or grievous illness or injuries, including serious bodily injury such as broken bones or concussion, catastrophic injury such as paralysis, or death. I have explained these risks to my participating minor child/children, if any. In spite of the risks mentioned above, I freely want to participate and want my child/children, if any, to participate in the activities provided by HERO Entertainment LLC. I understand that these activities may not be supervised and that, in the event of injury, medical services may not be readily available. Neither my participating minor child/children, if any, nor I are suffering from any mental, emotional, or physical condition precluding participation in any activities that HERO Entertainment LLC will provide. I, on behalf of myself and my participating minor child/children, if any, assume all of the risks of participating in any activities provided by HERO Entertainment LLC and/or on its premises.
- RELEASE AND WAIVER OF LIABILITY. I, on behalf of myself and my participating minor child/children, if any, hereby WAIVE AND RELEASE HERO Entertainment LLC and its agents, employees, officers, directors, affiliates, successors and assigns of and from any and all claims, demands, debts, contracts, expenses, causes of action, lawsuits, damages, and liabilities of every kind and nature, whether known or unknown, in law or equity, that I or my participating minor child/children, if any, ever had or may have, arising from or in any way related to my or their participation in any of the activities provided by, on the premises of, or for the benefit of HERO Entertainment LLC. This release and waiver of liability applies to all acts of ordinary negligence but does not apply to any acts of gross negligence or intentional, willful, or wanton misconduct.
- COVENANT NOT TO SUE. I, on behalf of myself and my participating minor child/children, if any, agree not to sue HERO Entertainment LLC or any of its agents, employees, officers, directors, affiliates, successors or assigns, or initiate or assist in the prosecution of any claim for damages or cause of action against any of them, which I, on behalf of myself or my participating minor child/children, if any, may have as a result of any personal injury, death, or property damage that I or my participating minor child/children, if any, may sustain by participating in any activities provided by HERO Entertainment LLC and/or on its premises.
- INDEMNIFICATION. I, on behalf of myself and my participating minor child/children, if any, agree to indemnify and hold harmless HERO Entertainment LLC and its agents, employees, officers, directors, affiliates, successors and assigns from any and all liabilities, claims, costs, and expenses (including reasonable attorneys’ fees) made by other individuals or entities as a result of my or my participating minor child’s/children’s actions in connection with any activities provided by HERO Entertainment LLC and/or on its premises.
- LOST, DAMAGED, AND STOLEN ITEMS. HERO Entertainment LLC has no responsibility for lost, damaged, or stolen items.
- PHOTOGRAPHS AND VIDEOTAPE. I, on behalf of myself and my participating minor child/children, if any, grant HERO Entertainment LLC the right to photograph, videotape, and/or record me and/or my participating minor child/children, if any, and to use my and my participating minor child’s/children’s name, face, likeness, voice, and appearance in connection with exhibitions, publicity, advertising, and promotional materials without reservation or limitation, and I, on behalf of myself and my participating minor child/children, waive any right to royalties or other compensation arising from any such use.
- SUCCESSORS AND ASSIGNS. This RELEASE AND WAIVER OF LIABILITY is binding on my and my participating minor child’s/children’s successors and assigns, including any spouses, heirs, executors, administrators, and legal representatives.
- GOVERNING LAW AND VENUE. This RELEASE AND WAIVER OF LIABILITY shall be governed by and interpreted in accordance with the laws of New York, without giving effect to the principles of conflicts of law. Any action arising out of this RELEASE AND WAIVER OF LIABILITY must be brought exclusively in a state or federal court located in New York County, New York.
- INTERPRETATION OF AGREEMENT. This RELEASE AND WAIVER OF LIABILITY shall be construed broadly to provide a release and waiver to the fullest extent permissible under applicable law. The failure of HERO Entertainment LLC to enforce any provision of this RELEASE AND WAIVER OF LIABILITY shall not be construed as a waiver or modification of such provision or impairment of its right to enforce such provision or any other provision of this RELEASE AND WAIVER OF LIABILITY.
- SEVERABILITY. If any provision or portion of this RELEASE AND WAIVER OF LIABILITY shall be held to be illegal, invalid, or unenforceable, the remaining provisions or portions shall remain in full force and effect.
- HEALTH & SAFETY PROTOCOLS. I, on behalf of myself and any participating adults and minor child/children, if any, under my care agree to adhere to any Health & Safety Guidelines in place by HERO Entertainment LLC and understand that failing to adhere to these policies/guidelines may result in removal of myself and my group from the premises. By failing to adhere to these policies/guidelines, I may not be eligible for a refund or exchange, as deemed by HERO Entertainment LLC.
- ENTIRE AGREEMENT. This RELEASE AND WAIVER OF LIABILITY contains the entire agreement between the parties and supersedes any prior written or oral agreements between them concerning the subject matter of this RELEASE AND WAIVER OF LIABILITY. The provisions of this RELEASE AND WAIVER OF LIABILITY may be waived, altered, amended, or repealed, in whole or in part, only upon the prior written consent of all parties. The provisions of this RELEASE AND WAIVER OF LIABILITY will continue in full force and effect even after the termination of the activities provided by, on the premises of, or for the benefit of HERO Entertainment LLC.
I, ON BEHALF OF MYSELF AND MY PARTICIPATING MINOR CHILD/CHILDREN, IF ANY, ACKNOWLEDGE THAT I HAVE CAREFULLY READ THIS RELEASE AND WAIVER OF LIABILITY AND THAT I UNDERSTAND THE TERMS SET FORTH HEREIN AND THAT I UNDERSTAND THAT IT IS A RELEASE OF LIABILITY AND A WAIVER OF RIGHTS THAT I MAY HAVE ON BEHALF OF MYSELF AND MY CHILD/CHILDREN TO BRING A LEGAL ACTION OR ASSERT A CLAIM FOR INJURY OR LOSS AGAINST HERO ENTERTAINMENT LLC. SHOULD ANY LEGAL ACTION BE COMMENCED OR ANY CLAIM ASSERTED IN VIOLATION OF THIS RELEASE AND WAIVER OF LIABILITY, I UNDERSTAND AND AGREE THAT I, ON BEHALF OF MYSELF AND MY PARTICIPATING MINOR CHILD/CHILDREN, IF ANY, WILL BE RESPONSIBLE FOR ALL REASONABLE ATTORNEYS’ FEES AND DEFENSE COSTS INCURRED BY HERO ENTERTAINMENT LLC D/B/A HERO NYC AND ITS AGENTS, EMPLOYEES, OFFICERS, DIRECTORS, AFFILIATES, SUCCESSORS AND ASSIGNS IN CONNECTION WITH OR IN DEFENSE OF SUCH ACTION OR CLAIM. I HAVE SIGNED THIS AGREEMENT FREELY, VOLUNTARILY, AND UNDER NO DURESS OR THREAT OF DURESS.
I have read and agree to the above waiver and accept it on behalf of myself and all participating adults and child(ren) under my care.
